These Terms and Conditions (“Terms”) govern your use of the website operated by Cooperative Publishing (“we,” “us,” or “our”), including all content, products, and services offered through our Shopify storefront (the “Site”). By visiting the Site or purchasing from us, you agree to be bound by these Terms.

1. Online Store & Eligibility

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence.

  • Order Refusal: We reserve the right to refuse service to anyone for any reason at any time.

  • Accuracy: You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store.

2. Intellectual Property & Public Domain

Cooperative Publishing specializes in both original creations and the restoration of public domain works.

  • Original Works: All original titles, text, and art created by our contributors are protected by standard copyright law.

  • Restored Public Domain Works: While the underlying source material may be in the public domain, our editions—including but not limited to typography, layout design, cover art, introductions, annotations, and digital restoration of imagery—constitute original derivative works. You may not reproduce, scan, or redistribute our specific editions without express written permission.

  • AI Restrictions: You are strictly prohibited from using any content from this Site or our products (digital or physical) for the purpose of training machine learning or artificial intelligence models.

3. Product Specifications

A. Physical & Print-on-Demand (POD)

We strive for accuracy, but because we utilize small-batch and POD processes:

  • Minor variations in paper weight, color calibration, and trimming ($+/-$ 1-2mm) are inherent to the process and do not constitute a defect.

  • POD items may ship from separate facilities and arrive in different packaging than small-batch items.

B. Digital Products

Upon purchase, you are granted a non-exclusive, non-transferable, revocable license for personal, non-commercial use.

  • Risk of Loss: The risk of loss for digital products passes to you upon the transmission of the download link to your provided email address. We are not responsible for lost files due to device failure or accidental deletion after the initial download.

  • Final Sale: All digital sales are final. Replacements will only be issued for verified file corruption.

4. Shipping, Risk of Loss, & Returns

  • Transfer of Title: Title and risk of loss for all physical goods pass to you when we deliver the items to the shipping carrier (e.g., USPS, UPS).

  • Porch Piracy: We are not responsible for packages that are marked as "Delivered" by the carrier but are missing or stolen.

  • Returns: Physical products may be returned within [30] days of delivery. Items must be in original, unread condition.

  • Damages: Please contact us at [Email] within 7 days of delivery with photographic documentation of any shipping damage to initiate a claim.

5. Pricing and Billing Errors

All prices are in U.S. Dollars. In the event a product is listed at an incorrect price due to a typographical or system error:

  • We reserve the right to cancel any orders placed for the product listed at the incorrect price, even if the order has been confirmed and your credit card charged.

  • If your card has been charged, we will issue a full refund immediately.

6. Cooperative Structure Disclosure

Cooperative Publishing is an artist-centered entity. The purchase of a product does not constitute a membership agreement. Customers do not acquire:

  • Voting rights or governance participation.

  • Equity, ownership, or profit-sharing interests in the Cooperative.

    Membership and governance are managed via separate legal bylaws not tied to retail transactions.

7. DMCA & Intellectual Property Claims

We respect the intellectual property of others. If you believe that any material on our Site infringes upon any copyright which you own or control, please send a notification to publishcooperative@gmail.com with the subject line "DMCA Notice."

8. Limitation of Liability & Indemnification

To the maximum extent permitted by law, Cooperative Publishing shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Site. Our total liability to you for any claim shall not exceed the amount paid for the product in question.

9. Governing Law & Venue
